A Notice of Termination can be filed when the site has effectively finished the construction stormwater work and there will be no ongoing discharges. The essential criteria are that final stabilization has been achieved for all disturbed areas and there are no discharges to surface waters, with local regulatory approval obtained in many jurisdictions. Having material storage areas with secondary containment is a good safety measure, but it is not a formal prerequisite for terminating coverage. Therefore, requiring all disturbed lands to be stabilized plus secondary containment for storage areas is not a necessary condition to request a NOT, making that combination the exception.
